Tourist Rentals in the Province of Alicante (Comunidad Valenciana)

Are you planning to rent out a property to tourists in the Comunidad Valenciana, the region that includes the Costa Blanca and Valencia? If so, it is important to be aware of the new legislation that came into effect on August 2, 2024, as described in Decreto-ley 9/2024 of the Generalitat. 

Why This Change in Tourist Rentals?

The new law aims to find a good balance between tourism and livability for local residents. With record tourism numbers in 2023 and 2024, the law seeks to create an organized tourism offer that is balanced with other accommodations. This helps prevent unfair competition by illegal rentals, protects the regulated tourism sector, and prevents black money circulation and conflicts with local residents.

Here are the most important changes and rules listed for you.

Main Changes for Tourist Rentals in the Comunidad Valenciana

  1. Rentals Shorter than 11 Days:
    • All rentals shorter than 11 days are considered tourist rentals.
    • Rentals of 11 days or longer are considered seasonal rentals and are not subject to this legislation.
  2. Tourist Permits:
    • Permits are valid for 5 years and must be renewed in time, at least one month before expiration.
  3. Homeowners' Association Declaration:
    • For new applications from August 2, 2024, a declaration from the Homeowners' Association (HOA) is required stating that tourist rentals are allowed.
    • This is not necessary for existing rental situations.
  4. Renting the Entire Property:
    • The property must be rented to tourists as a whole; room-by-room rental is not allowed.
  5. Cadastral Reference:
    • The cadastral reference must be mentioned on all official documents and contracts.
  6. New Application Upon Changes:
    • In case of renovation, new construction, sale, donation, or inheritance, a new application for tourist rental must be submitted.
  7. Combination Rental Not Allowed:
    • A property used for tourist rental may not be used for other types of rentals.
  8. Renting Within 2 Months:
    • The tourist rental license must be used within 2 months of issuance, or the permit will expire.

Requirements for Tourist Rental Properties

  • Evacuation Plan: Must be visible on the inside of the front door.
  • Elevator: Required in buildings with 4 or more floors.
  • Power Outlets: Must be present in all rooms.
  • Hot Water Supply: Mandatory.
  • Emergency Numbers: A list of emergency and important phone numbers must be in a visible place.
  • Climate Control: Cooling and heating must be available (at least in the living/dining room or kitchen).
  • Internet Connection: Unless the property is located in an area without coverage.
  • First Aid Kit: Must be present.
  • Medical Information: Detailed information about the nearest medical center.
  • Key Service: Keys in lockers on public roads are prohibited.
  • Cleaning and Maintenance Service: Regular cleaning and maintenance are mandatory.
  • Linens: Regular replacement of linens is required.

Minimum Furnishing Requirements

The property must be fully furnished and include:

  • Furniture, kitchenware, and linens.
  • Bedrooms: All bedrooms must have a wardrobe (either inside or outside the room).
  • Kitchen Equipment: At least a refrigerator, iron, oven/microwave, extractor hood, and electric stove (2-burner for properties up to 4 people, 3-burner for properties with 5 or more people).

Fines for Non-Compliance

The fines for non-compliance with these new rules range from €10,000 to €600,000, depending on the severity of the violation. For example, not correctly listing the property's location and registration details in advertisements, failing to report property transfers, or illegally offering tourist rental rooms.

Transitional Arrangements for Existing Licenses

There are three transitional arrangements for existing rental licenses:

  1. For properties with a license before July 1, 2018:
    • These may retain their license without modifications.
  2. For properties with a license between July 7, 2018, and the introduction of the new law:
    • These may retain their license, but must comply with the new requirements within five years and renew their approval before 2030.
  3. For new properties after the introduction of the new law:
    • These must immediately comply with the new rules and renew their approval and other papers every five years.

Rentals from 11 Days

These guidelines specifically apply to tourist rentals up to 10 days in the Comunidad Valenciana. Rentals from 11 days to 11 months fall under seasonal rentals and do not require a specific tourist license. Long-term rentals, from 11 months, are also allowed without a tourist permit.
